These Terms of Use ("Terms") constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you” or "User") and Black Pearl Consulting LLC (“Company”, “we”, “us”, or “our”), concerning your access to and use of the Falcon Dispute platform (the "Platform").

1. DESCRIPTION OF SERVICES
Falcon Dispute provides a proprietary Customer Relationship Management (CRM) and automated dispute processing software designed for credit repair organizations (“CROs”). The services include, but are not limited to, client management, automated dispute letter generation, case tracking, and workflow automation (the "Services").

2. NO FREE TRIAL AND SUBSCRIPTION TERMS
Falcon Dispute does not offer a free trial period. Access to the Platform is granted immediately upon successful payment of the required subscription fees. All subscriptions are billed in advance on a recurring basis.

3. STRICT NO-REFUND POLICY
All sales are final. Black Pearl Consulting LLC operates under a strict no-refund policy. * No credits or refunds will be provided for partial months of service, upgrades/downgrades, or for months unused with an open account.

By purchasing a subscription, you acknowledge and agree to this policy.

4. COMPLIANCE WITH LAWS (CRITICAL)
The User represents and warrants that their use of Falcon Dispute will comply with all applicable local, state, and federal laws. This is a software for professionals, and you are solely responsible for ensuring your business practices align with:

The Credit Repair Organizations Act (CROA)

The Fair Credit Reporting Act (FCRA)

The Telemarketing Sales Rule (TSR)

Gramm-Leach-Bliley Act (GLBA)Any violation of these laws by the User constitutes a material breach of this Agreement, and Black Pearl Consulting LLC reserves the right to terminate access immediately without notice.

5. DATA IMPORT LIMITATIONS
At this time, the Platform does not support the importation of external data or databases. The User is expressly prohibited from attempting to import bulk data or third-party CRM records. All client information must be entered manually within the Platform’s native environment.

6. LIMITED LIABILITY AND DATA BREACH INDEMNIFICATION
The Company’s liability regarding data security is strictly limited as follows:

Proven Responsibility: The Company shall only be liable for damages resulting from a data breach where it is conclusively demonstrated through a forensic audit that the Company was solely responsible due to a direct failure in its security systems.

Cap on Liability: In the event of such a proven breach, the Company’s total liability shall be limited to the total amount paid by the User to the Company during the twelve (12) months prior to the incident.

User Responsibility: The Company is not liable for leaks resulting from User negligence, such as shared passwords or unauthorized account access.

7. INTELLECTUAL PROPERTY RIGHTS
The Platform is our proprietary property. All source code, databases, functionality, software, website designs, and the "dispute round" logic are owned or controlled by Black Pearl Consulting LLC. No part of the Platform may be copied, reproduced, or reverse-engineered for any purpose.

8. PROHIBITED ACTIVITIES
You may not:

Circumvent or interfere with security-related features.

Engage in "data scraping" or use automated systems to extract Content.

Use the Platform to send unsolicited marketing (spam) in violation of the CAN-SPAM Act.

9. TERMINATION
We reserve the right to terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, for any reason, including but not limited to a breach of these Terms.

10. GOVERNING LAW
These Terms shall be governed and construed in accordance with the laws of the State of New Jersey, United States.
